When it comes to renting out a property, one of the most important steps is to have a proper lease agreement in place. But, who should be responsible for signing the agreement? As a landlord or property manager, it’s important to understand the best practices and scenarios surrounding residential lease agreement signatures.

Why Landlords Should Sign Rental Lease Agreements

As the property owner, landlords bear the ultimate responsibility for the property and any issues that may arise during the tenancy. By signing the lease agreement, landlords acknowledge their responsibility and agree to the terms outlined in the lease. This includes maintaining the property, dealing with repairs and maintenance, and ensuring tenants can peacefully enjoy the property.

When Property Managers Can Sign Residential Lease Agreements

In some cases, it may be appropriate for a property management firm to sign a lease agreement on the landlord’s behalf. For example, what if the landlord is out of the country and unable to sign the lease in person? In such cases, the landlord can authorize the property management firm to sign on their behalf. Additionally, if the landlord is not fluent in the language of the lease agreement, they may ask their property management firm to sign on their behalf. This could help ensure the agreement is translated and understood correctly.

Using Automation Tools for Rental Lease Signatures

Technology developments have made it easier for landlords and property managers to manage lease agreements and electronic signatures. Cloud web applications like PropHub.com can help streamline the process and ensure all parties are on the same page, regardless of who actually signs the lease agreement. With PropHub, you can easily manage lease agreements, e-signatures, and other rental management tasks. This helps makes your job as a landlord or property manager much easier.

Conclusion

Ultimately, it’s up to the individual landlord or property management firm to decide who should be selected for residential lease agreement signatures. However, it’s generally best for landlords to sign the lease themselves. In certain scenarios, such as when the landlord is out of the country or not fluent in the language of the lease, a property management firm may sign on the landlord’s behalf. With improved software tools, landlords and property managers can simplify the decision-making and execution of rental lease agreements.

We all love tips and advice that make our everyday lives easier right? Especially those who are at the very start of their landlord journey. We’ve put together a list of three landlord hacks that all you need to know, no matter where you are on your journey!

Landlord Hacks #1: Go Digital

One of the first landlord hacks is having an efficient and fast digital solution. Going digital and using software like ours, can help you keep organized and automate a lot of the important processes that usually take time and attention to detail. These processes can include collecting rent, rent reporting, maintenance request tracking and lease executions.

As a landlord, you’re responsible for a lot of important documentation that has to be kept securely. Make sure you invest in the proper software and/or digital infrastructure as it is a huge benefit!

Landlord Hacks #2: Plan Maintenance In Advance

Reactive maintenance can usually be quite expensive. Despite the high expense, this is a necessary action that needs to be tended to for the tenant. However, it also helps to think about maintenance in advance – things like checking and treating for mould and checking locks and doors are in good condition are early preventative measures that would be beneficial to check on regularly and fix before there’s a costly accident.

You can also use Prophub software to track and log maintenance requests so that everything is kept in one place!

Landlord Hack #3: Stay Educated on Landlord & Renter Rights

Saying educated on your state laws may seem intimidating but it’s absolutely necessary, especially if you’re a new landlord. In a worst-case scenario, you may encroach on a potential renter’s rights and face legal repercussions. You also never want to forget your own rights as a landlord.

When you evict a tenant, it’s important that you adhere to strict legal requirements regarding written notice, as ignoring this could get you into trouble if your tenant decides to take the legal route and rightly so.

Here’s all you need to know about writing and delivering an eviction notice letter.

What is an eviction notice letter?

Writing an eviction notice letter is the first step in the legal eviction process. By serving this notice, you’re communicating to your tenant that they need to vacate the property by a given date.

This document also acts as a record of the fact that you gave your tenant sufficient notice of their pending eviction. In the event of your tenant refusing to comply, you may have to take legal action. So, keep a copy of your notice once it’s drafted.

Every state has its own unique set of procedures when it comes to serving termination or eviction notices to tenants. Traditionally, landlords send eviction letters via certified mail. However, this is not required across the board.

You may have a specific reason or cause to evict a tenant. Typically, these reasons fall under two categories: a financial or material violation. But, these can specifically include:

Failure to pay rent

Violation of the lease

Property damage

Reports of illegal activity conducted on the premises

What Details Should I Include?

Depending on your lease agreement, the contents of your eviction letter may vary. However, as a general note, an eviction notice letter should include the following information:

The date

Your name

Your tenant(s) name(s)

Address of rental property

Reason for eviction

Date the tenant(s) must vacate the property

Eviction Letter Template

[Date]

[Full name]

[Property address]

[Your phone number]

Dear [tenant’s name],

This a notice to let you know you must vacate [rental property address] by [date tenant must vacate].

You have violated the lease agreement signed on [date lease agreement was signed] by [lease violation]. If you do not [pay/fix] or vacate by [date tenant must vacate], I will be forced to pursue legal action.

Please contact me at [your phone number] or [email address] with any questions.

Sincerely,

[Your name]

[Your signature]

Please ensure that you are giving your tenant adequate notice to leave, as this will alleviate further issues down the line.
